The First Appellate District of the California Court of Appeals recently ruled in McArthur v. McArthur that when a beneficiary is contending that the trust is invalid and should be set aside, and has never received benefits under such trust then the beneficiary is not bound by the arbitration clause in the trust instrument. The Court’s rationale being that the beneficiary never agreed to such an arbitration clause.
